1. Protecting your privacy
This document provides information about the personal information that we collect, and the ways in which we manage that personal information. We refer to this document as our Privacy Policy.
Your privacy is important to us. We comply with the Privacy Act 1988 (Privacy Act) when we handle personal information. The Privacy Act contains 13 Australian Privacy Principles (APPs) which provide the rules for how we must handle your personal information, including how you can request access to, and correction of, that information. Detailed information on the Privacy Act and the APPs can be found on the website of the Office of the Australian Information Commissioner (OAIC).
We will only use or disclose personal information we hold about you in accordance with this Privacy Policy or as otherwise notified to you.
2. Meaning of words
In this Privacy Policy:
(a) “you” refers to:
- (i) any individual who uses the Software;
- (ii) any entity which uses the Software;
(b) “Corporate User” refers to any entity that provides you with access to the Software;
(c) “related body corporate” has the meaning given in the Corporations Act 2001 (Cth);
(d) “Software” means the software licensed, developed and amended from time to time by D2K Information Pty Ltd and includes the architecture, source code and related technologies associated with or forming part of the such software;
(e) “we”, “us” and “our” refers to D2K Information Pty Ltd ACN 625 382 381 and any of its related bodies corporate to which it says that this Privacy Policy applies; and
(f) “Website” means our website available at https://www.d2kinformation.com/ as amended from time to time.
3. About D2K Information Technology
We are a specialist water quality monitoring technology and information provider.
We offer a complete range of water management software, including but not limited to Information Engine, CCP Watch, Audit Watch, Hop Watch and Algae Watch.
4. Your personal information
“Personal information” is information about an individual who is either identified in the information or their identity can be ascertainable from it. It includes information and opinions obtained from the individual or from a third party.
When you use the Software, your personal information is collected and held by us and may be made available to the Corporate User.
Your personal information that is obtained by the Corporate User via the Software must be collected and held in accordance with this Privacy Policy.
At or before the time (or, if that is not practicable, as soon as practicable after) we collect personal information, we will take steps to ensure that you are aware of:
(a) our identity and contact details;
(b) the facts and circumstances of collection of your personal information;
(c) the purposes for which the personal information is collected;
(d) the fact that you are able to gain access to the personal information;
(e) to whom we usually disclose personal information of the type collected;
(f) information about our Privacy Policy;
(g) any laws that require the particular personal information to be collected; and
(h) the main consequences (if any) if all or part of the personal information that is not provided.
5. What Information is Collected About you
Generally, we collect personal information regarding our clients, prospective clients, users of our Software, visitors to our Website and other individuals such as our service providers and contractors.
The type of personal information that we collect will vary depending on the circumstances of collection and the kind of service that you request from us, but will typically include:
(a) your name, e-mail and other contact details;
(b) the reason for your request;
(c) information about your employer or an organisation who you represent;
(d) your professional details; and
(e) any additional personal information you provide to us, or authorise us to collect, as part of your interaction with us.
6. How and Why we Collect and Use your Personal Information
We collect personal information reasonably necessary to carry out our business, to assess and manage our clients’ needs, and provide our services including supplying the Software. We may also collect information to fulfil administrative functions associated with these services, for example billing, entering into contracts with you and/or third parties and managing client relationships.
We do not ordinarily collect any information about you except where you provide it to us, or it is provided to us with your consent. In general, we do not use or disclose personal information collected about you other than for:
(a) a purpose set out in this Privacy Policy;
(b) a purpose you would reasonably expect;
(c) a purpose required or permitted by law; or
(d) a purpose otherwise disclosed to you or for which you have consented.
Your personal information may be used by us and a Corporate User to:
(e) verify your identity;
(f) price and design products and services;
(g) assist you to subscribe to products and services;
(h) provide the products and services you require;
(i) provide you access to the Software;
(j) notify you of new or changed services;
(k) arrange for the products and services you require to be provided by third party service providers;
(l) manage our relationship with you;
(m) administer, improve and manage their products and services, including charging, billing and collecting debts;
(n) conduct appropriate checks for credit-worthiness and for fraud;
(o) research and develop our products and services;
(p) research and develop a Corporate User’s services;
(q) gain an understanding of your needs in order to provide you with a better service and products;
(r) assist with the resolution of technical support issues or other issues relating to the Software and our services and products;
(s) carry out marketing or training;
(t) comply with the laws and regulations in applicable jurisdictions; and
(u) maintain and develop their business systems and infrastructure.
We generally collect personal information directly from you. We may collect and update your personal information over the phone, by email, over the internet or social media, or in person. We may also collect personal information about you from other sources, for example:
(v) our affiliated and related companies; and
(w) third-party suppliers and contractors who assist us to operate our business.
7. Use and Disclosures of Personal Information
We may exchange your information with our related bodies corporate. We and our related bodies corporate may use this information for any of the purposes mentioned in section 6.
We may also disclose personal information about you, as appropriate, to:
(a) our Corporate Users and their employees, assignees, agents, referred service providers, contractors and external advisers;
(b) our employees, assignees, agents, referred service providers, contractors and external advisers;
(c) organisations which verify your identity;
(d) your agents, advisers, referees, executor, administrator, trustee, the beneficiary of any trust of which you are a trustee, your guardian, attorney or franchisor;
(e) law enforcement, regulatory and government bodies;
(f) anyone who introduces you to us;
(g) your and our auditors, insurers or prospective insurers and their underwriters;
(h) any person we consider necessary to execute your instructions; and
other organisations (and their agents) with whom we have arrangements for the supply and marketing of our respective products and services, unless you ‘opt out’ of marketing (see below).
8. Do we Disclose Your Personal Information Overseas?
D2K is a global organisation and works with clients, service providers, sponsors and commercial interests across the globe. It is likely that your personal information will be disclosed to overseas recipients.
Unless we have your consent, or an exception under the APPs applies, we will only disclose your personal information to overseas recipients where we have taken reasonable steps to ensure that the overseas recipient does not breach the APPs in relation to your personal information.
9. How do we hold your Information
We store your information in our Software, paper-based files or other electronic record keeping methods in secure databases (including the Software). Personal information may be collected in paper-based documents and converted to electronic form for use or storage (with the original paper-based documents either archived or securely destroyed). We take reasonable steps to protect your personal information from misuse, interference and loss from unauthorised access, modification or disclosure.
We maintain physical security over paper and electronic data stores, such as through locks and security systems at our premises. We also maintain computer and network security, for example, we use firewalls (security measures for the internet) and other security systems such as identifiers and passwords to control access to our computer systems.
Our Website does not necessarily use encryption or other technologies to ensure the secure transmission of information via the internet. Users of our website such as yourself are encouraged to exercise care in sending personal information via the internet.
We take steps to destroy or de-identify information that we no longer require.
10. How we use and disclose your Personal Information for Direct Marketing
We may use or disclose your personal information for the purpose or informing you about our services, upcoming promotions and events, or other opportunities that may interest you.
If at any time you do not wish to receive further marketing information, you may ask us not to send you any further information about services and not to disclose your information to other organisations for that purpose. You may do this by contacting us at contact@d2kinformation.com . If you opt-out of receiving marketing material from us, we may still contact you in relation to its ongoing relationship with you.
11. Personal Information about Third Parties
If you provide us personal information about another person, you represent that you are authorised to do so and you agree to inform that person who we are, that we will use and disclose their personal information and that they may access any personal information we hold about them. You should also refer them to this Privacy Policy which applies to their personal information.
12. Maintaining the Accuracy of your Information
We take all reasonable precautions to ensure that the personal information we collect, use and disclose is accurate, complete and up-to-date.

13. Accessing your Personal Information

You may be required to put your request in writing for security reasons. We may also charge a fee for giving you access to your personal information and will try to deal with your request within a reasonable time.
14. Security & the Internet
You may visit our Websites without identifying yourself. If you identify yourself (for example, by providing your contact details in an enquiry), any personal information you provide to us will be managed in accordance with this Privacy Policy.
Our Website may contain links to third-party websites. We are not responsible for the content or privacy practices of websites that are linked to our Website.
We maintain strict procedures and standards and take all reasonable steps to prevent unauthorised access to, or unauthorised modification or disclosure of, your personal information and to protect it from misuse or loss.
However, we do not guarantee that information sent over the internet is secure.
15. Cookies on our Website and Software
We may use cookies on our website and Software. A cookie is an industry standard and is a small text file that our website or Software may place on your device(s). Usually, cookies are used as a means for software applications to remember your preferences. As such, cookies are designed to improve your experience of the applications.
Cookies may collect and store personal information about you such as your device type, browser type, IP address, pages you have accessed on our websites and on third-party websites. You are not identifiable from such information.

16. Can you deal with us anonymously?
We will provide individuals with the opportunity of remaining anonymous or using a pseudonym in their dealings with us where it is lawful and practicable (for example, when making a general enquiry). Generally, it is not practicable for us to deal with individuals anonymously or pseudonymously on an ongoing basis. If we do not collect personal information about you, you may be unable to utilise our services or participate in our event, programs or activities we manage or deliver.
17. Changes to this Privacy Policy
This statement sets out our current Privacy Policy. It replaces any other Privacy Policy which we have previously issued.

If your complaint requires more detailed consideration or investigation, we will acknowledge receipt of your complaint within a week and endeavour to complete our investigation into your complaint promptly. We may ask you to provide further information about your complaint and the outcome you are seeking. We will then typically gather relevant facts, locate and review relevant documents and speak with individuals involved.
In most cases, we will investigate and respond to a complaint within 30 days of receipt of the complaint. If the matter is more complex or our investigation may take longer, we will let you know.
If you are not satisfied with our response to your complaint, or you consider that we may have breached the APPs or the Privacy Act, a complaint may be made to the Office of the Australian Information Commissioner (OAIC).
